Minutes of the Board of Directors Meeting 

  1. Call meeting to order at 7:02 by the General Manager David Slavin
  2. Proof of notice of meeting: Given by Linda Satz, Director Secretary of the Board
  3. Quorum certified by Association General Manager David Slavin: Ilya G., Eugenia V., Boris E., Sofia F. About 35 owners and some guests present.
  4. Minutes of October 8th. 2015 approved as whole with dispensed reading.
  5. Motion to Ratify Special Assessment 2015 alternate payment plan approved unanimously.
  6. Parking Review: The President of the Board Ilya G. informed the existence of 8 additional parking spaces that will receive a special consideration to be specified by the Board in the near future. There will be changes in the Valet Service charge with price increases. Owners, Beauty Parlor and Restaurant concessions will be offered to purchase special reduced prices for the use of their guests. All others will pay new prices. Under this topic, the President emphasized the need to generate additional income for the building with Valet Parking activity and rental income to be paid by concession of Beauty Parlor and Restaurant.
  7. Security Cameras System contract to be awarded with AlarmOne firm. AlarmOne offer was chosen over three additional bidders (total four bidders). Forty five cameras to be installed, up to the 24 available in the old system. This passed with the votes of Ilya G., Boris E. and Linda S. Sofia F. and Eugenia V. casted two opposed votes.
  8. New Air Conditioning for common areas of the property will have a contract to be granted to VMACH firm that competed with three other vendors. Motion approved by all Board members. Repair bills for 2014 exceeded one hundred thousand dollars. New system will be more reliable and resilient.
  9. The eighteen Fire Code violations incurred in 2014 and 2015 have been resolved by Aquarius Condo. Association to the satisfaction of the competent authority. No pending Fire Code violations at this time.
  10. Presidents report:
    1. Lobby reconstruction work permits granted by City of Hollywood. Work to start immediately. New carpet ordered.
    2. Restaurant work about 80% completed. A stage partial beginning of activities to start in a couple of weeks.
    3. West Pool opened with celebration last Saturday October 25th. 2015. Some residents complained about intensity of lights on steps of deck.
    4. In the Gym most exercise machines working, some with repair in progress. Sauna and vapor room should be in operation very soon. The required equipment has been ordered.
    5. Garage gate to be operating in less than two weeks.
    6. Four new access doors are being installed in the two towers. Completion of service in one week.
    7. Valet Deck planters under progress. CSI the general contractor for the area insists planters to be filled before final paver’s installation for technical reasons.
    8. Temporary lightning system will be increased in garage until a final project is approved.
    9. Plans for sound system for Lobby, Green Room areas under study.
    10. Plans for audio visual system for Cascade room with support for meetings, projections, presentations and parties under study. One proposal already received.
    11. Internet access in Multipurpose Room will be provided by Comcast with speed of 80 Mbps. Previous access was of 6 Mbps. Under consideration, internet access to be provided at east and west pool decks. Restaurant concession has its own system that we expect to be made available to patrons.
  11. Miscellaneous
  1. Several questions were asked to the Board: (1) Was interest charged to late payments of regular and special assessment for months of June, July and August?     The BOD did not charge interest on amicable late payments. Interest will be charged only on lawyer assisted recovery efforts. It was observed that the BOD may be breaking its fiduciary duties by given amnesty to later payers even if amounts are very small. (2) Outstanding debt in assessment payments:      The V. President informed that even with a One Million payment due September 1st the outstanding arrears is of about $ 360,000. This is the same amount verified in the end of the month of August. (3) Financial statement of September of 2015?     It will be made available as soon as received from the accounting firm. It should occur in less than a week. (4) Publication of detailed monthly invoice from Legal Counsel Glazer?    It will not be done anymore under advice of the Attorney. Total amount of monthly invoice will be made public without details. The invoice of October was about twenty-three hundred dollars, down from about ten thousand dollars in September. (5) Statement of expenses already incurred in each item provisioned on Special Assessment of 2015?   Treasury Director Eugenia V. will prepare this report and will provide it every month.
  2. Contract to be awarded for Herman Plumbing for emergency work at the garage. Approved by the BOD unanimously.
  3. Joe Paes from the Global Services our security contractor made a summary presentation and reported that some training has been provided. He expects a noticeable increase in the level of service when garage gate is operational and when concierge desk in the Lobby is usable. Improvements in the handling of packages and positive identification of FOB users will be observed.
  4. President Ilya G. made a brief presentation on circumstances on the termination of Andrew Surdovel our previous General Manager. The early separation fee of $ 35 thousand dollars is being paid to A. Surdovel. This payment is responsibility of Atlantic Pacific Management.
  1. Meeting adjourned 8:30 pm

Aquarius Board of Directors Meeting of October 8, 2015 Minutes

  1. Call meeting to order: Meeting started 7:10 PM
  2. Proof of notice of meeting: Surdovel, General Manager, attested proof notice was posted 4:30 October 6th, 2015
  3. Certification of a Quorum: A. Surdovel verified quorum Ilya, Eugenia, Sofia, Boris and Linda present. About 40 Owners also present.
  4. Approval of Minutes of July 30, 2015: Copies of minutes were made available. Minutes were approved unanimously by Directors.
  5. A motion to approve One Global Service contract for Aquarius Security was approved unanimously. The President Ilya explained that with this contract the Condo. Association would get: Professional Training and Supervision, all security officers would be transferred to the Contractor, with better benefits and equal salary, more service hours per week 380 hours versus 350 hours and annual savings of near $ 30,000 per annun.
  6. A motion to establish the rule that only one Board member to communicate with the Association’s Law firm. This exclusive contact is Sofia. Approved with the opposition of Linda Satz, Board Secretary. This issue was object of discussion. Several Owners expressed reserve to excessive use of attorney consultations resulting in high expenses for the Condo Association.
  7. Motion to approve $1.5 million dollars Line of Credit with Banco Popular. Motion approved unanimously. This line of credit has two purposes: (1) Assure punctuality of Aquarius payments as contractors finalize their jobs and present their invoices. (2) Extend collection of last to installments of Special Assessment due November 11 and December 15. Owners that have their payments current will be able to opt for a modality of 10 payments from November 1st. on. Owners that opt for this modality will pay over 10 months the entire amount due and additional interest of about 3.5%. After the option is made the owner cannot modify it. Owners mentioned that the line of credit had been approved by previous Board. The President explained that the approval was to include the use of the line of credit to allow owners to pay final portion of Special Assessment 2015 in ten months provided the owners are current and pay a 3.5% interest.
  8. Motion to approve the Atlantic Pacific Management company to manage Aquarius. Approved by 4 votes 1 with Linda Satz opposed. This motion was subject of a presentation by William J. Coleman, Regional Manager of Atlantic Pacific. He informed that Atlantic Pacific is in charge of the management of neighboring buildings such as Wave, Trump and Residences of Hollywood.  Atlantic Pacific will manage Aquarius Condo. Association, assume maintenance and cleaning. It also will provide accounting, collections, payments, assistance on the 40 years Recertification exercise, Project Management of Reconstruction, schedule completion supervision, periodic reports, Management Reviews and other services.  Many owners questioned the BOD on the decision to terminate the General Manager Andrew Surdovel. Some argued that Mr. Surdovel tenure was very successful and he had been acting, simultaneously, as General Manager and Project Manager of the several project under development. The President of the BOD explained that a more professional and profound set of skills was necessary. The complexity of the 40 years Inspection and Recertification exercise would be very complex initiative and Atlantic Pacific would have the resources to provide help when needed. In addition it Mr. Surdovel has the opportunity to work with Atlantic Pacific in other properties. The contractual penalty Aquarius Condominium will incur for the anticipated termination of Andrew Surdovel will be paid by Atlantic Pacific.
  9. A motion to approve the purchase of outdoor furniture for the East Pool and the Aquarius Restaurant as suggested and procured by the Beautification Committee as approved by all members of the BOD.
  10. It was approved by all BOD members a motion to temporarily revoke the voting privileges for Unit owners who are 90 days delinquent on their account. In addition they will not have access to the common amenities such as swimming pools, gym, card and billiards room and other as determined by Aquarius declaration and rules and regulations.
  11. A motion to approve the proposed surveillance security camera system passed with 5 positive votes.
  12. President’s Report, Common areas and cooling handlers of Air Conditioning update: The President of the BOD informed that has received 3 bids for the project to replace the units in the actual configuration. He is the opinion that the actual custom configuration should be abandoned in favor of standard off the shelve units that would allow better acquisition price and easier maintenance. The BOD has already received one offer. Vendors were invited and a contract will be awarded after the Aquarius Condo Ass. has a minimum of 3 offers.
  13. Regarding the previous issue on the Air Conditioning for Aquarius there are 2 points to consider: (1) The level of noise of the new units that must be properly evaluated. (2) The need to contracts the elaboration of technical drawings with details on plumbing, electrical and mechanical aspects. The elaboration of these drawings will cost about $ 10,000.00. A motion to approve this expenditure carried with 5 votes.
  14. The meeting adjourned 9:00 P.M.

Aquarius Board of Directors proposes optional payment plan for Special Assessment 2015 last two installments

 

The option allows owners to pay in 10 installments the last two parcels of the Special Assessment of 2015.

This option will cost something between 3 to 4% for those who take it. Instead of two somewhat large payments for November 1st and December 15th, 2015 the payments are divided in equal amounts for ten months. The plan if approved requires the first payment November 1st and extends to August 2016.

AQUARIUS CONDOMINIUM ASSOCIATION, INC

To all Aquarius Unit Owners,

NOTICE IS HEREBY GIVEN that the Board of Directors will be meeting with Association Members for the purpose of discussion and adoption an optional schedule of payments for the remaining balance ($1,500,000) of the Special Assessment 4 2. The meeting will take place on Thursday, October 22, 2015 at 7:00 p.m, in the Restaurant, at 2751 S. Ocean Drive, Hollywood, Florida 33019.

The aggressive five-payment schedule adopted by previous Board caused serious financial difficulties to many unit owners and resulted in numerous delinquencies. Signing a Credit Line with one of the banks in mid-August 2015, with only One-year fixed interest rate, gave the current Board an opportunity to ease the burden and offer the Association an optional extended payment plan with the following, conditions:

  1. The plan is designed for 10 equal monthly payments

(See enclosed schedule).

  1. The monthly payments are calculated with 4.0°A interest to the total amount.
  2. The first payment is due November 1, 2015.
  3. The last (and tenth) payment is due August 1, 2016.

Your participation in this plan is purely optional, but your decision is final and cannot be changed later. You can continue with two remaining payments due on November 1, 2015 and December 15, 2015.

If you wish, please sign up for the extended schedule payments on this page and return it to the Aquarius Condominium Office before October 22, 2015. If you are currently in the buildings, you can sign up directly in the Aquarius Office.

ACG Engineering Services, our Aquarius Engineer Consultant submitted the following report on the progress of the work being performed by CSI on West and Valet Decks. He also present the progress on the work of Hollywood Tiles and the MSI Pool firm working at the West Deck.

Two notes:

  1. CSI has almost completed East end of the West Deck repairs. The boder of the deck had revestiment that had to be removed and caused some water damage at the hall at the Gym and Restaurant entrances. The work should solve these problems.
  2. The City of Hollywood has not granted the permit for the work at the Lobby. This week no work has been done.

ABSTRACT:

As per the Board’s request, we have prepared a project update on the different phases and projects in progress at the Aquarius Condominium. The following are the updates until October 1, 2015:

West Pool Upper Deck:

The contractor has finished the bathrooms. The two doors will be painted today and installed Saturday. They will clean the bathrooms and wait for the pavers to be fixed in order to close the permit. Hollywood stone has been on site but no work has been done. The manager has been calling them to be on site as soon as possible to call for final inspection

The pool company has finished the pool work. Hollywood Stone has said that they will not install the pavers around the pool. Perfect Picture has decided to do it themselves but there are not enough pavers. The owner of Perfect Picture has been in contact with the manager to address this issue. As soon as the pavers are installed by Hollywood Pavers around the bathroom, they will call for final inspection.

The landscaping contractor has finished planting all the planters. The manager has contacted Hollywood Stone to schedule the acid wash. The new canopy was rescheduled to be installed October 2, 2015.

Lobby Deck

CSI no work has been done on this area since last week.

 

Phase II, III and IV

 

 

 

The contractor has water tested Phases II, III and IV, from this water test we have marked two new drain locations. They have started building all the curbs and are planning to place them next week Friday (due to rain they are behind their schedule two weeks). The contractor has scheduled paver installation to start October 12, 2015. The manager has been notified that the stone and the soil for the two front planters should be delivered in the next two weeks. New planters have been ordered.

 

After meeting and agreeing with the contractor this are the phase %’s of completion:

Pet Rules, Regulations & Restrictions

September 29, 2015 Republication of Policy of April 19, 2012.

REAFFIRMATION: The Aquarius Condominium Association strictly prohibits pets, and the rules, regulations and restrictions herein are being adopted only for the purpose of regulating pets that are registered as grandfathered pets and/or approved service animals and/or support animals.  Service and/or support animals can obtain further exemption from particular rules, regulations and/or restrictions, subject to proof of medical need for same.  Any pet not registered within 30 days after the adoption of these Pet Rules, Regulations & Restrictions, will be subject to eviction.

As of the date of the “Republication” of the “No Pet Policy” on April 19, 2012, the following Pet Rules & Regulations apply:

  1. The terms “pet” or “animal” as used and referred to in these Pet Rules Regulations & Restrictions (except as used in this very next sentence, or when obviously used in a general way, are limited to dogs and cats. The maintenance, keeping, boarding, and/or raising of pot belly pigs, reptiles, rodents (i.e. mice,  gerbils, hamsters), snakes, alligators, exotic animals, birds, ants,  and any other animals, livestock, or poultry of any kind, regardless of number, is expressly prohibited.
  1. A Unit Owner (hereinafter referred to as OWNER) may not maintain more than one (1) pet in a Unit.  To the extent however that an OWNER maintained more than one pet in his/her Unit prior to the April 19, 2012 Republication, those pets shall be grandfathered and may continue to be maintained by such OWNER provided such pets are properly and timely registered, do not create a nuisance, or violate any of the other provisions governing the behavior of pets set forth herein or any rules or regulations adopted by the Board of Directors from time to time.
  1. Pets cannot exceed twenty (20) pounds at maturity.  OWNERS must produce a certificate from a licensed veterinarian certifying the pet’s weight upon registration with the Association.  Notwithstanding the foregoing, any pet(s) exceeding twenty (20) pounds for which the OWNER obtained the prior written consent of the Association or which is properly registered with the Association and was maintained by any OWNERS prior to the date of adoption of this amendment, shall be grandfathered and may continue to be maintained by such OWNER provided such pets do not create a nuisance or violate any of the other provisions governing the behavior of pets set forth herein or any rules or regulations adopted by the Board of Directors from time to time.  Upon the death or removal from the Unit of any grandfathered pet(s), such pet(s) may not be replaced.
  1. Domesticated pets (which are limited only to grandfathered pets and service and/or support pets) that are allowed to be maintained in a Unit, will be allowed provided such pets are: (a) permitted to be so kept by applicable laws and regulations, (b) not left unattended on balconies, terraces and patios (c) generally, not a nuisance to residents of other Units or of neighboring buildings and (d) not a pit bull or other breed considered to be dangerous or a nuisance by the Board of Directors (in its sole and absolute discretion); provided that neither the Board nor the Association shall be liable for any personal injury, death or property damage resulting from a violation of the foregoing and any OWNER and/or occupant of a Unit committing such a violation shall fully indemnify and hold harmless the Board of Directors, each OWNER and the Association, in such regard.  The following provisions shall also govern any pets on the Condominium and/or Association Property:
  1. Except as specifically provided immediately below, all pets must be carried at all times when outside of the Unit and on the Common Elements and/or Association Property, while also being tethered to a leash not more than six (6) feet long.
  1. At any time that a pet is being taken for a walk, it must be carried from the Unit, directly to the service elevator, and continued to be carried in the Service elevator, until taken into the lower parking garage. (If the Service Elevator is out of service or is otherwise being used for a move-in or move-out, the OWNER may carry the pet into one of the passenger elevators unless a request is made from any of the passengers already in the elevator, to use another elevator.)  In the lower parking garage the pet may be allowed to walk (while tethered), directly to the Emergency Pedestrian door (at the Southwest corner of the lower parking garage; or directly to the OWNER’S (or other appropriate) vehicle, if the pet will be traveling with the Owner, off-premises.  If the pet is unable to control itself while walking in the garage directly to the Emergency door or owner’s vehicle, it must be carried.  Pets shall only be walked off Condominium Property.  Under no circumstances shall pets be permitted in the pool area, on the pool deck or in the swimming pool.
  1. OWNERS shall, as soon as possible, pick up all solid wastes from their pets and dispose of same appropriately. OWNERS shall also clean up, as soon as possible, all liquid waste and/or other liquid or semi-liquid emission from their pet.
  1. Any damage to the building, grounds, flooring, walls, trim, finish, tiles, carpeting, stairs, etc., caused by a pet will be the full responsibility of the OWNER and the OWNER shall pay for any and all expenses involved in restoring damaged property to its original condition.
  1. Pets may not play or exercise in the corridors, stairwells, roof, laundry rooms, or other portions of the Condominium Property (including Limited Common Areas – such as terraces), but only in the OWNER’S Unit.
  1. Each OWNER agrees to underwrite the cost of necessary extermination in the OWNER’S Unit or other Units, Common Areas, Limited Common Areas, the lobby and any other part of the Association Property if the OWNER’S pet is responsible for the infestation of the building or portions thereof.
  1. Each OWNER agrees to restrain its pet in an appropriate manner.  Should it be requested either for cause or as the result of a justifiable request from the Association, the Board May require the pet to be muzzled when going through public areas).  Should any pet attack and/or bite any person while on Association property this shall be grounds for the Association to require the permanent removal of that pet from the premises.
  1. All cats must be spayed and declawed.
  1. All pets/animals MUST be vaccinated and/or inoculated in accordance with city and county requirements, and OWNER agrees to provide the Association with verification of the animals’ health in the form of a Health Certificate from a licensed veterinarian on an annual basis.
  1. All pets must be properly and timely registered with the Association and wear a special tag that will identify the pet.  The tag can be purchased at the Office at a current cost of $10.00.  Failure of any pet to wear such tag outside of the Unit in which it lives, and on condominium property, may subject the OWNER to a fine or penalty.  This rule goes into effect 30 days after these Ruled, Regulations & Restrictions are approved by the Board.
  1. Renters and/or other occupants of any Unit shall NOT be permitted to maintain any pets in Units.  However, any renters maintaining any properly registered pet(s) prior to the date of adoption of this amendment, shall be permitted to continue to maintain such pet(s) until the end of the current term of their lease, provided such pet(s) do not create a nuisance or violate any of the other provisions governing the behavior of pets set forth in the Association’s governing documents. Additionally, a Renter may petition the Board of Directors of the Association for a reasonable accommodation for a service animal or a support animal, and, if granted, must strictly comply with all requirements of these Rules, Regulations & Restrictions set forth and pertaining to Service and/or Support Animals. Renters maintaining pets in violation of these Rules, Regulations & Restrictions may be evicted.  Upon being granted this request, the Renter shall be included in the definition of OWNER for purposes of these pet Rules, Regulations & Restrictions.
  1. Any landscaping damage or other damage to the Common Elements caused by an OWNER’S pet must be promptly repaired by the OWNER on a timely basis.  The Association retains the right to affect said repairs and charge the OWNER therefor.  Without limiting the generality of these Rules & Regulations, a violation of the provisions of this paragraph shall entitle the Association to all of its rights and remedies, including, but not limited to, the right to fine Unit Owners (as provided in the By-Laws and any applicable rules and regulations) and/or to require any pet to be permanently removed from the Condominium Property.
  1. No visitors or guests may bring an animal into the Aquarius Condominium or onto Condominium Property.
  1. Pets cannot become a nuisance to other residents of the community, and must be maintained by OWNER so as not to disturb, annoy or frighten other owners, occupants and guests.  Factors constituting a nuisance include, but are not limited to, excessive barking, failure to properly clean up after the pet, aggressive behavior, etc. Should any pet create offensive noise or disturbance of any kind which deprives any neighbor of the Unit in which the pet resides, and such offended Unit Owner files a formal complaint with respect thereto, the Board of Directors reserves the right to take any action or actions allowed by law to address this situation.
  1. OWNERS, pet caregivers or other designee of an OWNER shall not use the washers and dryers, located on the garage level of the buildings to launder any pet’s bedding, toys, blankets, etc.
  1. Cat litter may not be disposed of in toilets. No pet waste may be dropped down trash chutes unless securely double-bagged in plastic bags.

PROCEDURES TO APPLY FOR SERVICE/SUPPORT ANIMALS AS AN ACCOMMODATION TO THE ASSOCIATION’S PET RESTRICTIONS

 

The policy of the Board of Directors of the Aquarius Condominium Association, Inc., is to make every attempt to provide reasonable accommodations to disabled or handicapped residents in accordance with state and federal law.

Any owner or resident that desires a reasonable accommodation in the form of a waiver of the Association’s Pet Rules & Regulations for use of a service/support animal shall notify the Association and provide information to the Board of Directors in compliance with Federal, State or Local Fair Housing laws justifying the need for such accommodation. The information that shall be required by the Board in order to meaningfully review the request shall include:

  1. A completed Application for Service/Support Animal Accommodation;
  1. An executed and acknowledged copy of the Association’s Policies and Procedures Regarding Service/Support Animal Accommodation Requests;
  1. A completed and executed Physician Certification Form from the prescribing physician; and
  1. A completed Animal Registration Form that identifies the animal by type, breed, name, age, color and size along with a photograph of the animal (if already acquired); evidence that all licenses and inoculations have been obtained; Contact information for the veterinarian; and contact information for care of the animal under emergency circumstances.
