A Group of Concerned Aquarius Owners Writes to the Board of Directors

To the Board of Directors:

A group of unit owners of Aquarius Condominium, formally express their collective concern regarding critical operational, managerial, and governance deficiencies that urgently require attention. The following issues have significantly impacted the community’s safety, functionality, and trust in leadership:

I. Operational and Maintenance Failures

  1. Construction Delays: Phase I of the construction project remains incomplete due to inadequate oversight, including overdue deadlines for the new beach stairs, ramp, and access door.

  2. Neglected Facilities:

    • Broken beach chairs and umbrellas remain unrepaired or unreplaced.

    • Persistent water leaks in the beauty salon and malfunctioning air conditioning in common areas and the restaurant.

    • Elevator failures, including the gym elevator being out of service for 13 days.

  3. Landscape Deterioration: Common areas suffer from decaying landscaping due to insufficient irrigation and maintenance.

II. Staffing and Resource Mismanagement

  • High Staff Turnover: Frequent personnel changes disrupt operations.

  • Misuse of Staff Roles:

    • Assigning the maintenance supervisor to non-core duties (e.g., accompanying exterminators).

    • Delegating custodial supervisors to cover office staff vacancies.

  • Security Concerns: Inadequate staffing and oversight compromising resident safety.

III. Lack of Financial and Operational Transparency

  • Budgetary Noncompliance: No annual operating or capital expenditure budget for fiscal year 2024 has been presented to owners, violating governance standards.

  • Exclusionary Governance:

    • Board agenda items and supporting materials are not shared with owners in advance, depriving stakeholders of meaningful review or input.

    • Decisions are routinely approved without owner consultation, fostering distrust.

IV. Request for Immediate Action

We suggest the following actions to restore accountability and functionality:

  1. Timelines for Resolution:

    • Provide a detailed schedule for completing Phase I construction and overdue projects (beach stairs, ramp, salon leaks, elevator repairs).

    • Submit a maintenance plan for landscaping, furniture, and common areas.

  2. Staffing Review: Restructure roles to align with expertise and ensure adequate security coverage.

  3. Transparency Measures:

    • Distribute budgets, agendas, and supporting materials at least 7 days prior to meetings.

    • Establish a formal process for owner feedback prior to Board votes.

  4. Special Meeting: Convene a forum  to address these concerns and present actionable solutions.

We expect written acknowledgment of this letter and a plan of action.

    YES PURE ENDLESS INSANITY , WITH NO LIGHT AT THE END OF TUNNEL. I HAVE SEEN SO MANY MISTAKES IN THE CONSTRUCTION WORK, THAT IT IS UNBELIEVABLE!

    ON JUST 2 WINDOWS IN MY APT…. I HAVE SEEN 7 MISTAKES…(WHICH I CORRECTED RIGHT ON THE SPOT)….SO BAD THAT I AM EVEN AFRAID TO LEAVE MY APT AND I MUST BABYSIT ALL WORK BEING DONE WHEN THE SCAFFOLD IS ON MY APT LEVEL!!

    EVERY CONSTRUCTION JOB IS A DISASTER (FACT) FROM START TO FINISH!

    REPAIRS STAY UNREPAIRED FOR YEARS ON END

    THE DOOR TO THE POOL FROM THE BEACH, ENTRANCE INTO THE GARAGE FROM THE BEACH, THE SHABBY DOOR AT THE TOP OF THE STAIRS, SERVICE ELEVATOR OUT OF SERVICE……THE LIST OF PROBLEMS IS ENDLESS

    CRACKED SUPPORT BEAMS IN THE GARAGE ENTRANCE ONTO THE BEACH

    DANGEROUS CONDITION, IN THAT ALL THE STEEL REBARS FOR STRUCTURAL SUPPORT INSIDE THE CONCRETE (THROUGHOUT THE WHOLE BUILDING ARE RUSTED AND WEAKENED)

    I ASSUME ONE OR MORE ENGINEERS WERE CALLED IN TO EXAMINE THE STRUCTURAL INTEGRITY OF THE BUILDING

    *{REFERENCING THE collapse of the Champlain Towers South apartment building in Surfside, Florida, was likely caused by a combination of factors, including structural deficiencies, poor construction practices, and the long-term effects of saltwater corrosion. Specifically, investigators found issues with the concrete columns supporting the pool deck and the garage below, including weaker-than-required concrete and the addition of weight from landscaping planters on the pool deck. 

    • Structural deficiencies:The pool deck was designed with a flat plate slab, which is prone to failure when subjected to concentrated loads, as seen with the columns. 
    • Poor construction practices:The concrete used in the columns and pool deck was weaker than required by building codes. 
    • Saltwater corrosion:The building’s location in a coastal area exposed it to the destructive effects of saltwater corrosion, particularly in the garage and pool deck areas. 
    • Overload:The pool deck experienced increased stress due to the added weight from landscaping planters that were heavier than initially designed for. 
    • Possible failure initiation:While the pool deck is a likely point of failure initiation, investigators are still exploring other potential triggers within the tower structure.} 

    SOME OF THE ABOVE MAY (?), APPLY TO OUR BLDG…..I ASSUME ALL OF THE ABOVE WAS ADDRESSED BY ONE OR MORE ENGINEERS AFTER THE COLLAPSE OF THE Champlain Towers South …….BUT with all the other negligent mistakes made and continue to be made since 1974…..I CANNOT BE REST ASSURED OF IT!

    ***WHEN THE AQUARIUS WAS BUILT IN 1974…..SO MANY CONTRACTORS WERE CUTTING CORNERS AND THE BUILDING CODES WERE WEAK

    The rainy season in Florida typically begins in mid-May and lasts through mid-October. While the Atlantic hurricane season runs from June 1st to November 30th.

    *THUS, NO CONSTRUCTION WORK INVOLVING “OUTSIDE AREAS”, SHOULD EVER BE UNTAKEN DURING THIS TIME FRAME (NOW AND IN THE FUTURE) PLEASE TAKE NOTE. (BUT WE “ALL” “WERE MORE THAN AWARE OF THIS FACT!!)

    LET ME NOT GET INTO THE VARIOUS “HORRIFIC/DANGEROUS PROBLEMS” THAT CAN ARISE IF ANY BUILDING/S IN THE TROPICAL/SUB-TROPICAL ZONES, TRIES TO UNDERTAKE A CONSTRUCTION PROJECT DURING THE ABOVE MENTIONED TIME FRAMES AS THE LIST OF PROBLEMS IS ENDLESS!!….

    …..SUCH AS (CONSTRUCTION PRODUCTS NOT CURING CORRECTLY DUE TO HUMIDITY, RAIN WEAKENING THE INTEGRITY OF THE CONSTRUCTION MATERIALS)…..I DO UNDERSTAND THAT WE ARE USING PRODUCTS MEANT TO WITHSTAND THE ABOVE ENVIRONMENTAL CONDITIONS LIKE SIKA FLEX AND OTHER CONSTRUCTION/WATERPROOF MATERIALS THAT CAN BE APPLIED IN WET/DAMP CONDITIONS…..BUT STILL APPLICATION DURING THE RAINY/HURRICANE SEASON IS STILL FAR FROM IDEAL!

    I HAVE SENT 2 EMAILS AND GOING FORWARD I REFRAIN FROM EVER COMMENTING AGAIN (ON ANY SUBJECT MATTER) AS I DID NOT MOVE HERE TO BABYSIT INCOMPETENT CONTRACTORS AND ALL OTHERS INVOLVED (WITHOUT MENTIONING NAMES!) SINCE THERE IS WAY TO MANY THINGS WRONG, WITH OUR BUILDINGS AND OTHER BUILDING

    *ALTHOUGH, WE PROBABLY WIN “THE STUPID AWARD” FOR HAVING A “SHABBY OCEANFRONT WALL/STAIRS/DOORS LEFT UNREPAIRED” FOR THE LONGEST AMOUNT OF TIME!

    IT FURTHER AMAZES ME WITH ALL SUPPOSEDLY EXTREMELY INTELLIGENT HUMANS IN THE AQUARIUS….THE THIS NONSENSE CONTINUES WITH NO END IN SIGHT

    I REFRAIN FROM EVER COMMENTING EVER AGAIN!!!

    PS A SHOUTOUT TO MARIA, RUSLAN AND ALL THE BOARD MEMBERS WHO GIVE UP THEIR FREE TIME TO TRY TO DO THE BEST TO SOLVE THESE ISSUES!
